These Terms of Service (“Terms”) govern your use of the OM Pharmacy website and services. By creating an account or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About OM Pharmacy

OM Pharmacy is an Australian pharmaceutical retailer and wholesaler operated from 25/16 Washington Avenue, Niagara Park NSW 2250. We supply retail customers with everyday health and wellness products, and supply approved pharmacies and healthcare businesses at wholesale.

2. Account Types

2.1 Retail (Consumer) Accounts

Retail accounts are for individuals buying pharmacy products for personal or family use. You must be at least 18 years old to create a retail account.

2.2 Trader (Wholesale) Accounts

Trader accounts are for approved Australian pharmacies and healthcare businesses. Trader account applications require:

  • A valid Australian Business Number (ABN)
  • A valid Pharmacy Approval Number (issued by your state pharmacy board)
  • The Responsible Pharmacist's registration number

We reserve the right to verify these details and approve or reject applications at our discretion. Approval typically takes 5-7 business days.

2.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorised access to your account.

3. Products and Availability

We aim to display accurate product information, but do not guarantee that descriptions, images, or pricing are error-free. In the event of an obvious pricing error, we reserve the right to cancel the order and refund any payment.

Product availability is subject to stock. We reserve the right to limit quantities, discontinue products, or cancel orders where necessary.

4. Prescription Products

Certain products require a valid prescription from a registered Australian medical practitioner. When purchasing prescription products:

  • You must upload a clear copy of your valid prescription at checkout
  • All prescriptions are reviewed by our pharmacy staff before dispatch
  • We may reject prescriptions that are unclear, expired, or otherwise invalid
  • If a prescription is rejected, you will be notified and given the opportunity to upload a replacement
  • Orders containing prescription items will not be shipped until all prescriptions are approved

By uploading a prescription, you confirm that it is genuine, valid, and issued to you (or the intended recipient) by a registered medical practitioner. Submitting a fraudulent or altered prescription is a criminal offence.

5. Orders and Pricing

All prices are in Australian Dollars (AUD). For wholesale (trader) customers, prices are shown excluding GST unless stated otherwise. For retail customers, prices include GST where applicable.

Placing an order is an offer to purchase. We reserve the right to accept or decline any order, in whole or in part. An order is only confirmed once we send an order confirmation and, where applicable, all prescriptions have been approved.

6. Payment

Payment terms and available methods are shown at checkout. All payments must be received before goods are dispatched, unless a separate credit arrangement has been agreed in writing with us.

7. Shipping and Delivery

We ship Australia-wide. Estimated delivery times are indicative only and not guaranteed. Risk in the goods passes to you upon delivery to the address you provided.

You are responsible for providing an accurate delivery address. We are not liable for delays or losses caused by incorrect or incomplete address details.

8. Returns and Refunds

Australian Consumer Law provides certain guarantees that cannot be excluded. Beyond those guarantees:

  • Damaged or incorrect items: Notify us within 7 days of delivery. We will arrange a replacement or refund.
  • Change of mind: Change-of-mind returns are not accepted on pharmaceutical products, opened items, or products that have left our controlled temperature chain.
  • Prescription products: For safety and regulatory reasons, prescription products cannot be returned once dispatched.

9. Cancellations

You may cancel an order at any time before it has been dispatched. Once an order has shipped, cancellation is not possible, but you may return eligible items in accordance with our returns policy.

10. Acceptable Use

You agree not to:

  • Use the site for any unlawful purpose
  • Attempt to access, modify, or disrupt our systems
  • Impersonate any person or entity
  • Submit false information, including fraudulent prescriptions
  • Use automated tools to scrape, copy, or interact with the site
  • Resell retail products under a wholesale account, or vice versa

We may suspend or terminate accounts that breach these Terms.

11. Suspension and Termination

We reserve the right to suspend or terminate any account at our discretion, including for:

  • Breach of these Terms
  • Fraudulent or suspicious activity
  • Non-payment of amounts owed
  • Failure of pharmacy licensing verification

12. Intellectual Property

All content on the OM Pharmacy website — including text, graphics, logos, product descriptions, and images — is owned by us or our licensors and protected by copyright and trademark law. You may not reproduce or use any content without our written permission.

13. Limitation of Liability

To the maximum extent permitted by law, OM Pharmacy's liability for any loss or damage arising from your use of our services is limited to the amount you paid for the products or services in question. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including under the Australian Consumer Law.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users via email or a prominent notice on our website. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
